This is the website for the Irish ASR Hip Alternative Dispute Resolution (“ADR”) Process.

The ADR Process was approved by Court Order made by Mr Justice Cross on 16 December 2015. For details on how to apply, please review the Court Order or see tabs above.

LATEST UPDATE:  The report to Mr Justice Coffey dated 18 December 2023 is available here. 857 claims have been resolved including by direct negotiation and the ADR Process.

Other reports and announcements

On 14 January 2021, the Chairman of the Evaluators gave a written direction as to the interpretation of clauses 5.6, 5.7, 5.10 and 5.13. See link.

The High Court delivered a judgment on 20 December 2019 which confirms how the ADR Process operates.  Mr Justice Cross said in his decision: “Without the existence of the scheme I do not believe that the large number of cases that have been compromised by the parties would have been done so.”

Mr Justice Cross delivered a judgment on 5 May 2017 calling on parties to progress their claims in the ADR Process. By May 2017, more than 400 claims were resolved by direct negotiation or through ADR.

Please see costs announcement: €25,000 in respect of costs, expenses and VAT will be paid to plaintiffs’ solicitors within 28 days of settlement of claims within the ADR Process. This does not prejudice any right to seek higher costs and expenses in the circumstances of the case, though taxation or negotiation. The announcement also offers to help plaintiff’s solicitors collect medical records in these cases.
